Oxford Standard for the Citation of Legal Authorities

Þjóðréttarsamningar, Alþjóðlegir dómar og ákvarðanir, Sameinuðu þjóðirnar

Vísa skal í alþjóðlega þjóðréttarsamninga í opinbera útgáfuröð þeirra t.d. UNTS (United Nations Treaty Series), CTS (Consolidated Treaty Series) eða LNTS (League of Nations Treaty Series). Ef það er ekki mögulegt skal vísa í opinbera útgáfuröð aðildarríkjana: t.d. UKTS (UK Treaty Series), ATS (Australian Treaty Series). Alltaf er val um að vísa einnig í Stjórnartíðindi C deild ef það er kostur, sjá kaflann Íslenskar frumheimildir. 

  • Tilvísunin á að innihalda fulla dagsetningu þegar samningurinn var samþykktur (eða undirritaður) og þegar hann tók gildi og í þessari röð, athuga að þýða skal mánaðarheiti.
  • Ekki er þörf á að telja upp alla aðila í marghliða samningi, en ef um tvíhliða samning er að ræða skal skrá aðildarríkin í sviga strax á eftir titli með bandstrik á milli (sjá dæmi hér fyrir neðan undir tvíhliða samningar).
  • Fyrst er árgangur skráður, síðan skammstöfun ritraðar og loks upphafssíða þar sem lokagerð samnings hefst. Ekki skal taka fram lokagerð í titlinum T.d. Convention relating to the Status of Refugees: the Final Act eða lokagerð hefst á bls. 137 í vol. 189 UNTS, en texti samningsins hefst ekki fyrr en á bls. 150. Rétt tilvísun samningsins væri því: 189 UNTS 137 (síðan gæti höfundur bætt við pinpoint eins og við á t.d. 189 UNTS 137, 151.
  • Pinpoint í greinar samninga eiga ekki að innihalda titil greinarinnar (ef hann er fyrir hendi), einungis skal skrá númer og svo gr. eða grein.
  • Ef við á má skrá styttra heiti/gælunafn samnings í sviga fyrir framan pinpoint, í fyrsta sinn sem samningur er nefndur. Leyfilegt er að nota síðan styttra heitið/gælunafnið einungis í seinni tilvísunum.

Í fyrstu tilvísun skal taka fram styttra heiti/gælunafn samnings í sviga á eftir titli og á undan pinpoint. Höfundar geta búið til sín eigin gælunöfn fyrir samninga. Dagsetning er yfirleitt ekki skráð fyrir Evrópska þjóðréttarsamninga þar sem þeim hefur oft verið breytt nokkrum sinnum. Ef dagsetning er hluti af titli skal þó skrá hana og eins ef það er nauðsynlegt v/skýrleika.

Vísið til ritraðar International Court of Justice ICJ (Reports of Judgements, Advisory Opinions and Orders) ef kostur er. Skjöl tengd málum eins og skriflegur málflutningur og munnleg röksemdarfærsla eru útgefin eftir ákvörðun í ritröð er nefnist Pleadings, Oral Arguments, Documents á ensku og frönsku. Ef heimildin hefur ekki verið útgefin í ritöðunum vísið í vefsíðu ICJ og tilgreinið hvenær skoðað.

The Permanent Court of International Justice (PCIJ) er forveri ICJ og var starfræktur frá 1922-1945. Ákvarðanir og álit PCIJ eru útgefin í opinberri ritröð PCIJ. Ýmis önnur gögn dómstólsins sem ekki eru útgefin í ritröðinni eru aðgengileg á vefsíðu ICJ og skal vísa í þau þar og tilgreina hvenær skoðað.

Vísið í heiti dóms eins og hann birtist í ritröð ICJ, í sumum tilvikum birtist orðið Case fremst í titli, ef skrifað er á íslensku skal í slíkum tilvikum skrifa Mál.

The International Law Reports (ILR) hefur verið útgefið frá 1919 en undir mismunandi titlum: 1919 - 1932 (árg. 1-6) hét það Annual Digest of Public International Law Cases, 1933-1949 (árg. 7-16) Annual Digest and Reports of Public International Law Cases og frá 1950- (árg. 17-) undir núverandi titli ILR.

Ákvarðanir dómstólanna International Criminal Tribunals for the former Yugoslavia and Rwanda eru útgefnar í mismunandi ritröðum. En vísa skal til ICTY og ICTR ef kostur er. Tilvísun í ICTY og ICTR inniheldur málsaðila, (tegund ákvörðunar), ICTY/ICTR, ár, númer og dagsetningu. Einnig er mögulegt að vísa í International Legal Materials (ILM) eða International Human Rights Reports (Intl. Human Rights Rep). En þá endar tilvísunin á árg. - skammstafaður titill ritraðar - upphafsblaðsíða ákvörðunar.

d) World Trade Organization (WTO/GATT) ákvarðanir:

Tvær leiðir eru mögulegar til að vísa í WTO ákvarðanir:

  •  í gagnasafn WTO: docsonline.wto.org. hér þarf tilvísun að innihalda titil, dagsetningu, WTO númer, pinpoint í málsgrein
  •  í Dispute Settlement Reports (DSR). Tilvísun fylgir almennum reglum um ritraðir dóma/ákvarðana. Pinpoint skal innihalda blaðsíðutal eins og við á, einnig er mögulegt að vísa í málsgreinar ef það þykir nauðsynlegt vegna skýrleika.

ILO gefur út ýmis gögn er varða alþjóðalög um vinnulöggjöf, þ.á.m. tilmæli, frumvörp, skýrslur, ályktanir frá the Committee on Freedom of Association og athugasemdir frá the Committee of Experts on the Application of Conventions and Recommendations, meðal annarra.

Sameinuðu þjóðirnar:

Þegar vísað er í skjöl aðalstofnanna Sameinuðu þjóðanna á tilvísun að innihalda númer skjals, stofnun SÞ sem ber ábyrgð á skjalinu og hvers konar skjal um er að ræða. Ekki er nauðsynlegt að vísa í Security Council Official Records (UNSCOR) eða General Assembly Official Records (GAOR). Eftir fyrstu tilvísun á að stytta United Nations í UN; UN Security Council í  UNSC, UN General Assembly í  UNGA og Resolution í Res. En hins vegar er mælt með því að vísa í fullt heiti stofnana SÞ sem ekki eru vel þekktar eða mjög sérhæfðar. Ekki á að vísa í titla ályktana (resolutions), nema það sé nauðsynlegt vegna skýrleika.  Nánari leiðbeiningar má finna í UN Documents Resource Guide (https://research.un.org/en/docs).

Meginregla tilvísana: Höfundur/stofnun - titill - dagsetning (samþykkt) - UN númer

Ef skjalið er gefið út sem bók og hefur ISBN nr. á titillinn að vera skáletraður og þá má sleppa UN númerinu. Fyrsta tilvísun á að innihalda óstytt heiti höfundar/stofnunnar.
